Terms of Service

1. Acceptance of Terms

By accessing or using FlashPost services, you agree to be bound by these Terms of Service. If you are using the services on behalf of an organization, you represent that you have authority to bind that organization to these terms. If you do not agree, do not use the services.

2. Service Description

FlashPost provides transactional email infrastructure, including SMTP relay, REST API endpoints, webhook delivery, DNS management, and analytics. We reserve the right to modify or discontinue features with reasonable notice. Service-level commitments are outlined in the plan you subscribe to.

3. Account Responsibilities

You are responsible for maintaining the security of your account credentials and for all activity under your account. You must provide accurate contact information and promptly update it if it changes. You agree to notify us immediately of any unauthorized use.

4. Acceptable Use

You agree not to use the service to send unsolicited bulk email (spam), malicious content, or material that violates applicable law. You must comply with CAN-SPAM, CASL, GDPR, and other applicable regulations. We reserve the right to suspend accounts that violate these policies without prior notice.

5. Payment Terms

Paid plans are billed in advance on a monthly or annual cycle. Overages are billed at the rates published on our pricing page. All fees are non-refundable except as required by law. We reserve the right to adjust pricing with 30 days' written notice.

6. Service Level

We target 99.9% uptime for API and SMTP relay services. Details and remedies are described in our Service Level Agreement, which is incorporated by reference. Scheduled maintenance windows are communicated at least 48 hours in advance.

7. Termination

Either party may terminate the agreement at any time with written notice. Upon termination, your access to the services will cease and we will delete your data within 30 days, except where retention is required by law. Outstanding obligations survive termination.

8. Limitation of Liability

To the maximum extent permitted by law, FlashPost shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the services. Total liability shall not exceed the fees paid by you in the twelve months preceding the claim.

9. Governing Law

These terms are governed by the laws of the jurisdiction in which FlashPost is incorporated, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts of that jurisdiction, unless otherwise required by mandatory consumer protection law.
